Terms and conditions of sale

1. About us

Mattress Town (mattresstown.co.uk) is a trading name of HCH Commerce Limited, a company registered in England and Wales under company number 15551960. Our registered office is Bury Farm Church Street, Bovingdon, Hemel Hempstead, England, HP3 0LU. Our VAT number is GB482483173.

You can contact us by email at info@mattresstown.co.uk or by phone on 020 8264 0042, Monday to Friday, 8am to 4pm. HCH Commerce Limited also runs Millie & Jones, and the two shops share a phone line and customer service team.

2. These terms

These terms apply when you buy from us as a consumer. Please read them with our delivery policy, returns and refunds policy and privacy policy. If you're buying for a business, see section 12.

3. Your order

When you place an order, we'll email to confirm we've received it. Our contract with you starts when we email to confirm your order has been dispatched. If we can't accept your order, for example because an item is out of stock or there's an error in its price or description, we'll tell you and refund you in full.

4. Prices and payment

Prices are in pounds sterling and include VAT. Any delivery charge is shown at checkout before you pay. We take payment when you place your order. If we've made an obvious mistake in a price, we'll contact you before dispatch, and you can choose to go ahead at the correct price or cancel for a full refund.

5. Our mattresses

We list each mattress's size in centimetres, its depth and its firmness. Small differences in measurements are normal for mattresses. If a mattress is far enough from its listed size that it doesn't fit a standard frame of that size, it's faulty and we'll put it right. Our firmness ratings, on a scale of 1 to 10, are a guide for comparing mattresses within our range, as there's no industry-wide firmness scale. Colours on screen can vary slightly from the real thing.

For bunk beds, high sleepers, cabin beds and trundles, please check the maximum mattress depth marked on your bed and choose a mattress that's the same depth or less. Ask us if you're unsure.

6. Delivery

Delivery areas, times and charges are set out in our delivery policy. If something outside our control delays your order, we'll tell you as soon as we can and do what we can to reduce the delay. If the delay is significant, you can cancel and we'll refund you for anything not delivered.

The goods are your responsibility from the time they're delivered to the address you gave us, and they become yours once we've received full payment.

7. Your right to cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you can cancel your order within 14 days, starting the day after delivery, without giving a reason. Our returns and refunds policy explains how to cancel, what returning items costs and how refunds work. To cancel, email or call us. You can use the model cancellation form from the regulations, but you don't have to.

8. If something is wrong

We must supply goods that are of satisfactory quality, fit for purpose and as described. What happens if something is wrong is explained in our returns and refunds policy. Any manufacturer's guarantee is in addition to your legal rights. For advice about your rights, contact Citizens Advice.

9. Our responsibility for loss or damage

If we break these terms or are negligent, we're responsible for loss or damage you suffer that is a foreseeable result. We're not responsible for loss or damage that isn't foreseeable.

We don't exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breaking your legal rights in relation to the goods.

We supply mattresses for domestic and private use. If you use them for a business, we're not liable to you for loss of profit, loss of business or business interruption.

10. Your personal information

We use your personal information only as set out in our privacy policy.

11. Complaints

If you're unhappy with anything, please contact us first. We'll reply within 2 working days and do our best to put things right.

12. Buying for a business

If you buy as a business, the 14-day cancellation right in section 7 doesn't apply, and our total liability to you is limited to the price of the goods you bought, except where the law doesn't allow us to limit it.

13. Other terms

We may update these terms from time to time. The version on our website when you place your order is the one that applies to it. If a court decides any part of these terms is invalid, the rest still applies. Nobody else has any rights under these terms.

14. Which laws apply

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts there.
